1. Introduction

Welcome to Myelin Health.

These Terms of Use (“Terms”) govern your access to and use of the Myelin Health website, patient platform, clinician platform and any related services (collectively, the “Platform”).

By creating an account, accessing or using the Platform, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use Myelin Health.

Please read these Terms together with our Privacy Policy and any other policies referred to within these Terms.

Throughout these Terms, “Myelin Health”, “we”, “our” and “us” refer to Myelin Health, the operator of the Platform, contactable at myelinhealthlabs@gmail.com. Formal registered company details will be published here once incorporation is complete.

2. About Myelin Health

Myelin Health is a digital health platform that enables individuals and healthcare professionals to securely collect, organise and better understand health information.

The Platform brings together information such as laboratory results, body measurements, wearable device data and clinician recommendations to support informed conversations between patients and healthcare professionals.

Myelin Health provides evidence-based educational content and clinical decision support tools.

The Platform is not intended to diagnose medical conditions, replace professional medical judgement or provide emergency medical care. Clinical decisions remain the responsibility of the treating healthcare professional.

3. Eligibility

To use Myelin Health you must:

• be at least 18 years of age;
• provide accurate and complete information when creating an account;
• keep your account information up to date;
• comply with these Terms and all applicable laws.

If you are creating an account on behalf of a healthcare organisation, you confirm that you have authority to do so.

4. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity carried out using your account.

You agree to:

• keep your login credentials secure;
• notify us promptly if you believe your account has been compromised;
• ensure that the information associated with your account remains accurate and current; and
• not allow another person to access the Platform using your account.

We reserve the right to suspend or restrict access where we reasonably believe an account has been used in breach of these Terms or where necessary to protect the security of the Platform.

5. Acceptable Use

When using Myelin Health, you agree to use the Platform responsibly and in accordance with applicable laws.

You must not:

• use the Platform for any unlawful purpose;
• interfere with or disrupt the operation or security of the Platform;
• attempt to gain unauthorised access to any part of the Platform or its underlying systems;
• introduce malicious software or code;
• copy, reverse engineer or attempt to extract the source code of the Platform except where permitted by law;
• use automated tools to access the Platform;
• impersonate another individual or organisation; or
• upload information that you do not have the legal right to provide.

We may suspend or terminate access where we reasonably believe these Terms have been breached.

6. Health Information

You are responsible for ensuring that any information you upload or provide through the Platform is accurate, complete and, to the best of your knowledge, up to date.

Where Health Information is entered by a Clinician, the Clinician is responsible for ensuring that the information reflects their professional judgement and is entered in accordance with applicable professional and legal obligations.

Myelin Health provides a secure platform for storing, organising and presenting Health Information. We do not independently verify the accuracy or completeness of information uploaded by users or Healthcare Organisations.

7. Clinical Decision Support

Myelin Health provides evidence-based educational content and clinical decision support tools to assist in the interpretation and organisation of health information.

Recommendations presented through the Platform are intended to support informed conversations between Patients and Healthcare Professionals.

The Platform is not intended to:

• diagnose medical conditions;
• prescribe treatment;
• provide emergency medical advice; or
• replace the independent judgement of a qualified Healthcare Professional.

Healthcare Professionals remain solely responsible for all clinical decisions, diagnoses, treatments and recommendations made in relation to their patients.

Patients should always consult an appropriately qualified Healthcare Professional regarding any questions about their health or treatment.

8. Responsibilities of Healthcare Professionals

Healthcare Professionals using Myelin Health agree to:

• maintain appropriate professional registration where required;
• comply with applicable laws, professional standards and regulatory requirements;
• exercise independent clinical judgement at all times;
• review information before relying upon it in clinical practice;
• ensure recommendations provided to Patients are appropriate to the individual circumstances of the Patient; and
• maintain the confidentiality of Patient information.

Nothing within the Platform removes or limits the professional responsibilities owed by Healthcare Professionals to their Patients.

9. Responsibilities of Patients

Patients using Myelin Health agree to:

• provide accurate information where requested;
• keep their account information up to date;
• protect their account credentials;
• seek professional medical advice where appropriate; and
• use the Platform responsibly and in accordance with these Terms.

Patients acknowledge that Myelin Health provides information to support understanding of health information but does not replace consultation with a qualified Healthcare Professional.

If you believe you are experiencing a medical emergency, you should immediately contact your local emergency services or seek urgent medical attention.
